The terms “Shoppington,” “we,” “us” and “our” refer to Shoppington. Shoppington operates this website and store, including all related information, content, features, tools, products and services made available to you through the website or our physical store.
Our online store is powered by Shopify, which enables us to provide our online shopping services to you.
These Terms of Service, together with any policies referred to in them, explain your rights and responsibilities when you access our website, purchase products from us, visit our store or otherwise use our services.
Please read these Terms carefully. They include important information about orders, payments, delivery, intellectual property, warranties, liability and your rights under New Zealand law.
By accessing or using our website, placing an order, creating an account or purchasing from Shoppington, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms or our Privacy Policy, you should not use our website or services.
Nothing in these Terms limits or excludes any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or any other applicable New Zealand law.
Section 1 – Access, Eligibility and Customer Accounts
By using our services, you confirm that you are at least 18 years old or have the permission and supervision of a parent or legal guardian.
You may browse our website without creating an account. However, you may be asked to provide information such as your name, email address, billing address, shipping address, phone number and payment details when placing an order.
You confirm that all information you provide is accurate, current and complete and that you are authorised to provide it.
You are responsible for maintaining the confidentiality of your account details and password and for all activity carried out through your account.
You must notify Shoppington promptly if you believe your account has been accessed or used without your permission.
Section 2 – Products and Product Information
Shoppington offers a wide range of products, including outdoor water features, garden products, gifts, homeware, fashion, jewellery, New Zealand-made products, pounamu and bone carvings, toys, games and children’s books.
We make all reasonable efforts to ensure that product descriptions, specifications, images, measurements, colours, pricing and availability are accurate.
However - please note:

Colours may appear differently depending on your screen, lighting or device settings.

Handmade, natural, stone, concrete, timber, ceramic, pounamu, bone and hand-finished products may vary in colour, texture, grain, markings, finish or appearance. This is natural, normal characteristics of handmade products.

Product measurements and weights are approximations only.

Water flow, sound and appearance may vary depending on pump strength, installation, water level, surface levelling and environmental conditions.

Product images may include display items, plants, stones, accessories or styling elements that are not included unless expressly stated.
Please read each product description carefully and contact us before ordering if you require clarification.
We may update, amend or correct product information at any time without notice.
Section 3 – Orders and Acceptance
When you place an order with Shoppington, you are making an offer to purchase the selected products.
Your order is not accepted until:

We have received and processed payment or agreed payment terms;

We have confirmed product availability; and

We have issued an order confirmation or otherwise confirmed acceptance.
An automatically generated order acknowledgement does not necessarily mean that your order has been accepted.
We may decline or cancel an order where:

A product is unavailable;

The price or product information was incorrect;

Payment was not authorised;
-
We suspect fraudulent, unlawful or unauthorised activity;

Delivery is not available to the address provided;
-
The order cannot reasonably be fulfilled;

There has been an obvious pricing or listing error; or
-
The quantity ordered is not reasonable for normal retail purchase.
If we decline or cancel an order after payment has been received, we will refund the amount paid unless another arrangement is agreed.
Please review your order carefully before submitting it.
Cancellation requests are subject to the status of the order and our Purchase Options Cancellation Policy. We may be unable to cancel an order once it has been processed, dispatched, prepared for collection, specially ordered, customised or committed to production.
Returns, exchanges and refunds are handled under our Returns and Refunds Policy and applicable New Zealand consumer law.
Unless otherwise agreed, products purchased from Shoppington are intended for personal or household use and not for unauthorised commercial resale or export.
Section 4 – Prices, GST and Payment
Unless otherwise stated, prices displayed on our New Zealand website are in New Zealand dollars and include GST.
Shipping, freight, handling, rural delivery, installation, customs, import duties or other charges may apply and will be shown at checkout or confirmed before dispatch where they cannot be calculated automatically.
Prices, discounts, promotions and product availability may change without notice.
Prices shown online may differ from prices offered in our physical store, at events, through third-party marketplaces or under separate promotional arrangements.
Promotions may be subject to additional terms, including:

Start and end dates;

Stock availability;

Product exclusions;

Minimum purchase requirements;

One offer per customer;
-
Discount code requirements; and
-
Restrictions on combining offers.
Where promotional terms conflict with these Terms, the specific promotional terms will apply.
You confirm that you are authorised to use the payment method supplied and that sufficient funds or credit are available.
Payment may be processed by Shopify Payments or another third-party payment provider. Shoppington does not directly store complete credit card details.
Section 5 – Pre-orders, Deposits and Special Orders
Selected products may be available for pre-order, special order or purchase using a deposit.
Estimated arrival dates are provided in good faith but are not guaranteed. Delays may arise from manufacturing, shipping, freight, customs, port congestion, supplier delays, weather or other circumstances outside our control.
Depending on the product, we may require:

Full payment at the time of order;
-
A deposit with the balance payable before dispatch or collection; or
-
Another agreed payment arrangement.
Pre-order and deposit cancellations are handled under our Purchase Options Cancellation Policy.
Specially ordered, customised or specifically manufactured products may not be eligible for cancellation or change-of-mind return once the order has been confirmed or costs have been incurred, except where required by law.
Section 6 – Shipping and Delivery
Shipping and delivery are subject to our Shipping and Delivery Policy.
Delivery timeframes are estimates only and are not guaranteed.
Shoppington is not responsible for delays caused by courier companies, freight providers, severe weather, road closures, customs processing, natural disasters, industrial action, regional disruption or other circumstances outside our reasonable control.
For large, heavy or bulky products, including outdoor water features:

Delivery may be made to the nearest safe and accessible point;

Delivery does not necessarily include placement, installation or movement to the final position;
-
You may need to provide suitable access, equipment and assistance;
-
Tail-lift, rural, remote, difficult-access or redelivery charges may apply;
-
You must advise us before dispatch of any access restrictions.
You are responsible for ensuring that the delivery address is correct, complete and accessible.
Additional costs caused by incorrect address details, unsafe access, failed delivery, redelivery or return to sender may be charged to you.
We do not deliver standard courier orders to PO Box addresses.
Section 7 – Click and Collect
Click and collect orders may be collected from:

Please wait until we confirm that your order is ready before travelling to collect it.
You may be asked to provide your order confirmation and proof of identity.
For large or heavy products, you are responsible for bringing:

A suitable vehicle;
-
Appropriate restraints or tie-downs;
-
Protective materials; and
-
Sufficient assistance for loading and unloading.
Shoppington may assist with loading at its discretion, but you remain responsible for ensuring that the product is safely secured before leaving the premises.
Section 8 – Installation, Assembly and Product Use
Unless expressly stated, products are supplied without installation.
You are responsible for:

Checking that the product is suitable for the intended location;

Preparing a safe, stable and level base;
-
Following all instructions and safety guidance;
-
Using appropriate electrical connections;
-
Engaging qualified tradespeople where required;
-
Ensuring children and pets are appropriately supervised; and
-
Maintaining the product correctly.
Outdoor water features must be installed on a stable and level surface.
Electrical pumps, lights and accessories must be connected and used in accordance with manufacturer instructions and applicable New Zealand electrical requirements.
Shoppington is not responsible for loss or damage caused by:

Incorrect installation;
-
An unstable or unsuitable base;
-
Failure to level the product;
-
Incorrect pump use;
-
Improper electrical connection;
-
Failure to maintain water levels;
-
Frost, weather, wind, earthquakes or ground movement;
-
Misuse, neglect or unauthorised modification;
-
Failure to follow instructions; or
-
Movement or installation by unqualified persons.
This does not exclude liability that cannot lawfully be excluded.
Section 9 – Returns, Refunds and Consumer Rights
Returns and refunds are governed by our Returns and Refunds Policy.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 where that Act applies.
Products that are faulty, damaged, incorrectly supplied or not of acceptable quality will be assessed and remedied in accordance with applicable law.
Change-of-mind returns are not automatically required by New Zealand law and are subject to Shoppington’s Returns and Refunds Policy.
Section 10 – Intellectual Property
The Shoppington website and its content, including text, product descriptions, photographs, graphics, videos, audio, logos, branding, page layouts and design elements, are owned by or licensed to Shoppington and are protected by applicable copyright, trademark and intellectual property laws.
You may use our website for personal and non-commercial shopping purposes only.
You must not, without prior written permission:

Use Shoppington photographs or videos commercially;

Modify or create derivative works from our content;

All third-party brands, product names and trademarks remain the property of their respective owners.

We do not necessarily control or monitor these tools.
Third-party tools are provided on an “as available” basis and may be subject to separate terms and privacy policies.
Your use of third-party tools is at your own discretion and risk.
To the extent permitted by law, Shoppington is not responsible for loss or damage arising solely from the operation or unavailability of third-party tools outside our reasonable control.

These links are provided for convenience and do not necessarily mean that Shoppington endorses or controls the linked website.
We are not responsible for the accuracy, security, content, availability, products, services or privacy practices of third-party websites.

Section 13 – Relationship with Shopify
Shoppington is powered by Shopify, which enables us to provide our online services to you.
However, purchases made through our online store are made directly between you and Shoppington.
Shopify is not the seller of Shoppington products and is not responsible for the fulfilment, quality, safety or legality of products sold by Shoppington.
To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from purchases or transactions between you and Shoppington.
Nothing in this section affects rights that cannot lawfully be excluded.
Section 14 – Privacy
Personal information collected through our services is handled under our Privacy Policy and applicable New Zealand privacy law.
Because our website is hosted by Shopify, Shopify may collect and process personal information necessary to provide and improve its services.

We may remove customer content that we reasonably consider unlawful, misleading, offensive, irrelevant or in breach of these Terms.
Section 16 – Errors, Inaccuracies and Omissions
From time to time, our website may contain typographical errors, inaccurate information or omissions relating to:

Shoppington will honour all warranties, guarantees and remedies required under New Zealand law.
We do not guarantee that:

Outdoor products will remain unchanged through weathering and use;

Estimated delivery dates will always be met; or

Section 22 – Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under New Zealand law.
To the maximum extent permitted by law, Shoppington will not be liable for indirect, incidental, special or consequential loss arising from your use of the website or products, including loss of profit, revenue, business opportunity, data or anticipated savings.
Where liability can lawfully be limited, Shoppington’s total liability in connection with a product or transaction will not exceed the amount you paid for the relevant product.
This limitation does not apply to fraud, wilful misconduct, personal injury caused by negligence, or other liability that cannot lawfully be limited.
Section 23 – Indemnity
To the extent permitted by law, you agree to indemnify Shoppington, Shopify and their respective officers, employees, contractors and service providers against third-party claims, losses, liabilities and reasonable costs arising directly from:

This section does not require you to indemnify Shoppington for loss caused by Shoppington’s own negligence, unlawful conduct or breach of these Terms.

Shoppington will not be liable for delay or failure to perform obligations caused by events outside our reasonable control, including:

Import, customs or border delays.
Where such an event affects your order, we will make reasonable efforts to communicate with you and provide available options.
Section 25 – Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be modified or severed to the minimum extent necessary.
The remaining provisions will continue in effect.
Section 26 – Waiver and Entire Agreement
If Shoppington does not immediately enforce a right under these Terms, that does not mean the right has been waived.
These Terms, together with our Privacy Policy, Returns and Refunds Policy, Shipping and Delivery Policy, Purchase Options Cancellation Policy and any other terms expressly incorporated by reference, form the agreement between you and Shoppington concerning use of our services.
Section 27 – Assignment
You may not assign or transfer your rights or obligations under these Terms without Shoppington’s prior written consent.
Section 28 – Governing Law
These Terms are governed by the laws of New Zealand.
You and Shoppington submit to the non-exclusive jurisdiction of the New Zealand courts.
Nothing in this section prevents either party from using an applicable disputes tribunal, mediation process or statutory consumer dispute process.
Section 29 – Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, website, services, policies or legal obligations.
The current version will be published on this page with the date of the latest update.
Where required by law, we will provide reasonable notice of material changes.
Your continued use of the services after changes take effect means that the updated Terms will apply to your future use and purchases.
Changes will not unfairly alter the terms of an order already accepted unless required by law or agreed with you.
